## **Documents For Consideration When Principal Signs A** ***Power Of Attorney***

Various documents might usefully be [created](https://wiki.powersofattorney.com/creation/create#terms-like-create-or-make-a-power-of-attorney-have-various-meanings) at the same time as a *Power of Attorney*.

For example:-

- in **California**, [§4503](https://codes.findlaw.com/ca/probate-code/prob-sect-4503.html) speaks of a [certificate issued by a lawyer](https://docs.google.com/document/d/e/2PACX-1vS0BdVomD1Y0nmQhTEJQqc1ZZ2ZQsJ9Xh8TMxMO5c2-Owlwhfic9Aopaq9PU37szgOhhln8ewm381HY/pub) recording the names of persons the principal prefers be excluded as petitioners and [§4230](https://codes.findlaw.com/ca/probate-code/prob-sect-4230.html) speak of records evidencing terms of any agreement entered by an [agent](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) that requires the [agent](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) to act
- in **Texas**, [§751.201](https://codes.findlaw.com/tx/estates-code/est-sect-751-201.html) and [§751.203](https://codes.findlaw.com/tx/estates-code/est-sect-751-203.html) provides for the [creation](https://wiki.powersofattorney.com/creation/create#terms-like-create-or-make-a-power-of-attorney-have-various-meanings) of a [*Certificate of Durable Power of Attorney By Agent*](https://docs.google.com/document/d/e/2PACX-1vQ9FVkkUVJ95KXpg8qxzeELKiNU49Z-pfdsKPQMTA9cNy3ur0LFVtQmYMi-wPT4YBHpGnVKMU4x0geL/pub) which seems intended to be issued when requested by a [third party](https://wiki.powersofattorney.com/terms#meaning-of-third-party), however there may be purpose in having a [§751.203](https://codes.findlaw.com/tx/estates-code/est-sect-751-203.html) certificate executed when the *Power of Attorney* is signed by the [principal](https://wiki.powersofattorney.com/principal#the-principal-is-the-entity-that-makes-the-power-of-attorney), confirming matters like the mental competency of the [principal](https://wiki.powersofattorney.com/principal#the-principal-is-the-entity-that-makes-the-power-of-attorney) (*unless perhaps the Power of Attorney operates subject to a contingency, in which event such a certificate could not be executed until the contingency has occurred, see paragraph 4 of the certificate*)
- in **Florida**, there may be purpose to [creation](https://wiki.powersofattorney.com/creation/create#terms-like-create-or-make-a-power-of-attorney-have-various-meanings) of Affidavits by [agents](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) under [§709.2119](https://codes.findlaw.com/fl/title-xl-real-and-personal-property/fl-st-sect-709-2119.html), which like the certificate in **Texas** referred to above, confirms the bona fides of the *Power of Attorney* with respect to matters like the [principal](https://wiki.powersofattorney.com/principal#the-principal-is-the-entity-that-makes-the-power-of-attorney) being alive, the [agent](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) being duly authorized to act and similar
- In **Illinois**,[§2-8](https://codes.findlaw.com/il/chapter-755-estates/il-st-sect-755-45-2-8.html) recognizes a certificate or Affidavit may be [created](https://wiki.powersofattorney.com/creation/create#terms-like-create-or-make-a-power-of-attorney-have-various-meanings) by an [agent](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) verifying bona fides of a *Power of Attorney* and [§2-10.3](https://codes.findlaw.com/il/chapter-755-estates/il-st-sect-755-45-2-10-3.html) recognizes that a [successor agent](https://wiki.powersofattorney.com/successoragents#a-successor-agent-replaces-an-original-agent-who-is-ineligible) may provide a certificate or Affidavit verifying bona fides of a *Power of Attorney* and there may be purpose in preparing these documents at the time that a *Power of Attorney* is signed by the [principal](https://wiki.powersofattorney.com/principal#the-principal-is-the-entity-that-makes-the-power-of-attorney)

## Importance Of Retaining All Relevant Documents

Comprehensive record-keeping and access to all [records](https://wiki.powersofattorney.com/recordkeeping#any-list-of-relevant-records-is-substantial) pertaining to a *Power of Attorney* is fundamental to its operation.

Unless any interested person (*i.e. an [agent](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) or [third party](https://wiki.powersofattorney.com/terms#meaning-of-third-party)*) can for example, access [records](https://wiki.powersofattorney.com/recordkeeping#any-list-of-relevant-records-is-substantial) establishing who is appointed or not appointed as an [agent](https://wiki.powersofattorney.com/agentswhatisagent#an-agent-is-an-entity-appointed-by-the-principal-to-represent-and-bind-the-principal) at any point in time, there are considerable risks.

Ideally, a 'shared database' of relevant [records](https://wiki.powersofattorney.com/recordkeeping#any-list-of-relevant-records-is-substantial), including records of appointments, [resignations](https://wiki.powersofattorney.com/termmng#renouncement-resignation), [renouncements](https://wiki.powersofattorney.com/termmng#renouncement-resignation) and similar would be accessible at all times.

Of course, relevant [records](https://wiki.powersofattorney.com/recordkeeping#any-list-of-relevant-records-is-substantial) are not limited to records pertaining to appointment.

All documents coming into existence at any time that relate to a *Power of Attorney* would ideally be stored in one location and access to those [records](https://wiki.powersofattorney.com/recordkeeping#any-list-of-relevant-records-is-substantial) facilitated as appropriate.
